The www.magdaviore.com (hereinafter referred to as the "Website") is the website that hosts the Online Store under the trade name "www.magdaviore.com," which displays, promotes, and sells clothing, footwear, accessories, household items, etc. via the Internet. The Website is owned by the sole proprietorship under the name "MAGDALINI VIORE," based in P. Faliro, Attica, Greece, at 66 Parthenonos Street (Tax Identification Number: 124738169 / Tax Office KEFODE ATTICA), with GEMI number 66261303000 and email info@magdaviore.com (hereinafter referred to as the "Online Store," the "e-shop," the "Business," the "Company," "we," "us," "our"), which legally manages it.
The present Terms and Conditions of the Online Store, which include as an integral part and a single whole the Terms of Purchase, the Shipping and Returns Policy, the Privacy Policy, and the Cookies Policy (hereinafter referred to as the "Terms and Conditions," "Terms of Use" or "Terms"), set out the terms and conditions that you, in any capacity, i.e. as a visitor, consumer, buyer, user, or member (hereinafter referred to as the "User," "Consumer," the "Customer," "you," "yours," "yours") browse our Website, use its content and Services, and/or transact in the Online Store by making purchases. These Terms govern the distance sales contract you enter into with the Company for the purchase of products from the Online Store.
Before entering the Website and using our Services or making purchases in the Online Store, we invite you to consult the Terms and Conditions and ensure that you agree with them. If you disagree with any of these Terms and Conditions, you must not take any action or use any Service, including simply browsing our Website. If you require any clarification or have any questions regarding these Terms of Use, you may, before taking any action, contact the Company's Customer Service Department using one of the contact methods listed in the "Contact Us" section of the Website. By taking any action on the Online Store, such as browsing it, creating an account, subscribing to our Company's Newsletter, or purchasing our products, you confirm that you have read, understood, and unconditionally accepted the Terms and Conditions.
The Company reserves the right to unilaterally amend these Terms and Conditions, in whole or in part, at its sole discretion and/or when any change, as above, is required by law. The Company undertakes to inform you of any changes in accordance with the above, through the Website, which will be effective from the date of their posting on this Website. It is clarified that any change to these Terms and Conditions does not apply to orders or other transactions and uses of Services that you have already made before the changes take effect, in accordance with the above, and which our Company has accepted. Any action, use, or transaction you make in the Online Store after the above Changes are made is considered unconditional acceptance of them.
The Company reserves the right at any time, without justification and without prior notice to the User, to cancel, suspend, or terminate the operation of the Website/Online Store or certain Services or the marketing of certain Products.
Your use of this Website and any transaction you make in our Online Store is at your sole responsibility.
The sale of Products and/or the opening of an Account in the Online Store is only available to natural persons who have full legal capacity (over 18 years of age) and to legal entities. The Online Store is intended for retail customers. The Company reserves the right to refuse to sell or deliver products to any natural or legal person if there are indications that any of the above terms are being violated.
II. PROTECTION OF PERSONAL DATA
The management and protection of your personal data is governed by the terms of the Privacy Policy and the relevant provisions of both Greek and Community law relating to the protection of individuals with regard to the processing of personal data, as well as the decisions of the Hellenic Data Protection Authority (HDPA).
For your information regarding the personal data you provide to us, the type of data we keep about you, the processing we carry out and the purposes thereof, the recipients thereof, as well as your rights over your data and other related information concerning their protection and security, please consult the Privacy Policy in order to read and accept these terms. The processing of personal data is carried out in accordance with the provisions of the General Data Protection Regulation (GDPR 2016/679) and Greek law 4624/2019, any more specific national and European legislation for certain sectors, the applicable Greek legislation on the protection of personal data, as well as for the protection of personal data and privacy in the electronic communications sector (Law 3471/2006, as applicable) and the decisions of the Hellenic Data Protection Authority (HDPA).
III. TERMS OF PURCHASE THROUGH THE ONLINE STORE
Placing an order through the e-shop constitutes a distance sales contract, governed by the legislative framework of Law 2251/1994, as amended and in force. The seller is the sole proprietorship.

THE PRODUCTS
Our Company, through its Website, displays, promotes, and offers for sale to retail and wholesale customers our products, such as clothing, footwear, and accessories (hereinafter referred to as the "Products").
The information accompanying the Products displayed on the Website (e.g., prices, availability, features) is complete and accurate, and the photographs thereof are a true representation of our Products. However, the above guarantees are subject to any technical or typographical omissions or errors that cannot be foreseen or have arisen unintentionally or due to interruptions in the operation of this Website or due to force majeure.
In particular, with regard to the information provided on the availability of Products, our Company has taken all necessary technical and other measures to ensure that the availability of our Products is updated immediately, but it expressly reserves the right to the validity of the Products available in the Online Store, as the information may be updated within one (1) hour from the time of their modification.

ORDER
In order to place your order, you must first check whether the country and/or postal code of the area to which you wish to ship the products you wish to purchase is currently served as a shipping destination. If the country/postal code-area you entered is not served, you can contact us by sending an email (info@magdaviore.com), so that we can inform you.
Placing an order through the Website constitutes a distance sales contract, subject to the relevant legal framework (Article 4 of Law 2251/1994, as applicable). Ordering Products constitutes a binding purchase offer on your part, as a User of the Website, and automatically entails an obligation to pay the amount of the order.
Persons who have reached the age of eighteen (18) and have legal capacity may place a valid order through the Website and, by extension, enter into a distance sales contract.
Your orders can be placed throughout the day, every day of the week.
Placing an order – Completing a sales contract:
Place the Products you wish to purchase in your shopping cart by clicking on the "SHOPPING CART" link/icon. Once you have placed the final Products in your "SHOPPING CART," continue by clicking on the "COMPLETE ORDER" button.
To complete your order, you must provide us with certain information that is important for processing your order: first name, last name, email, telephone number, postal address (street, number, city, postcode, country), as well as your card details if you choose to pay by debit/credit card.
Once you have filled in these details and clicked on the "COMPLETE ORDER" button, you will see a summary of your order with all the details, including payment and shipping information. If you agree, there is one more step to submit your order: click on the field to accept these Terms and Conditions and the Privacy Policy. Once you have accepted our Terms and Conditions and Policies, click on the "COMPLETE ORDER" button, at which point your order will be completed and submitted to our Company.
You are required to provide complete and accurate information when placing your order. By completing your order, you unconditionally declare that you are the legal/authorized user of the credit or debit card you provide us with. When paying by card, your details are collected directly and solely by the payment provider we work with to process payments (namely SHOPIFY PAYMENTS). If we are informed by the bank that there is a problem with the card details, we reserve the right to reject the order or withdraw from the sale at any time. If you choose to pay for your order in interest-free installments, the specific terms and conditions of the bank you work with apply. The Company bears no responsibility for any problems that may arise in relation to your credit card and the repayment of installments, for the resolution of which the Customer should contact the bank directly.
Once you submit your order, you will be connected to the payment provider we work with, depending on the payment method you choose. You can pay using one of the methods listed below in the "PAYMENT METHODS" section.
Your order is completed upon acceptance by the Company by sending a written confirmation (confirmation email) to you at the email address you provided when placing the order. If you do not receive a confirmation message for your order, please contact us at info@magdaviore.com.
Upon completion of the order and its registration in accordance with the above, the Company examines whether the order can be fulfilled in its entirety or whether there are reasons for its rejection in accordance with the terms described in this document. If the order is accepted, the process of shipping your Products begins, either through the courier company we work with or through another company. We will notify you by email sent to the address you provided when placing your order, which will include the shipping/waybill number. With this number, you will be able to track your order through the courier company's website until it reaches the delivery location you specified when placing your order.
If, upon receipt of your order, we find that a product is suddenly out of stock or there is a delay in its delivery, or if the product is temporarily unavailable for any reason (such as a delay in shipment from the supplier due to transportation problems or force majeure), the Company will contact you immediately at the contact details you have provided to discuss possible modifications, cancellations, or corrections to your order. If we are unable to contact you within three (3) business days of completing your order, we will send you an informational email with the changes made to your order. Specifically, the part of the order that can be fulfilled will be shipped as normal, while the Products that are unavailable will be canceled. If you have already paid for the canceled Products, the Company will refund the corresponding amount as soon as possible, and you acknowledge and agree that our Company owes you no compensation in this case.
ATTENTION: The sending of the email confirming receipt of your order in accordance with the above does not constitute acceptance of your order on our part, but simply confirmation - notification that we have received it. The order you submit to the Company constitutes an offer on your part to our Company to purchase the Products listed therein. In order for a sales contract to be concluded between us, we must also accept your order as it stands in order to execute/deliver it. Such acceptance is made by us when we send you the email confirming the dispatch of your order "as is." However, the sales contract for the Products is only executed once the Products have been paid for, i.e. once your card has been credited or your order has been paid for in the case of cash on delivery.

OPENING AN ACCOUNT
Opening your personal Account is not a prerequisite for placing your order and making a purchase from our Online Store. However, opening your own Account makes you a Member and allows you to access your order/purchase history purchases from the Online Store, keep a list of your favorite Products, record your addresses or any other personal data to facilitate your purchases, etc.
The registration process and the opening of your Account in the Online Store is done by entering your e-mail and password. The process is free, personal, and non-transferable. You are responsible for the data you provide, and the Company processes it only for the purpose of creating and managing your account. By registering, you declare that you understand and unreservedly accept our Company's Privacy Policy and Terms of Use.

ORDER CANCELLATION
Order cancellation by you:
A) For any order cancellation (total or partial), you must send an email to info@magdaviore.com on the following days: Monday to Friday from 10:00 a.m. to 6:00 p.m. and Saturday from 10:00 a.m. to 2:00 p.m.. This option is strictly available for one hour after placing the order.
B) In addition, if our Company modifies your order in accordance with the provisions herein, you have the option to cancel your entire order or the part of it that cannot be fulfilled by us.
Order cancellation by us:
A) Due to a technical error, the Product you have ordered is not available and the system has not been updated, and/or when it is no longer possible for our Company to supply it for any reason whatsoever.
B) Non-payment.
C) Non-receipt of the Products in accordance with the terms hereof.
D) The execution of the order violates laws, rules, and regulations.
E) In cases of force majeure.
If the Product of the cancelled order has been paid for, the Company will refund your money without undue delay.
Cancellation after receipt of the product:
After receiving the Product, the order is canceled by exercising the right of withdrawal, as specified below in the section "RETURN OF PRODUCTS/WITHDRAWAL". Any refusal to receive your Products upon delivery by the courier company is equivalent to withdrawal.

PRICES
All prices quoted for products available through the Company are in euros and include 24% VAT but do not include shipping or cash on delivery charges. These prices apply to the Products and quantities, provided they are available and sufficient, while the Company reserves the right to change the prices of the products sold without prior notice.

METHOD – TIME – SHIPPING COST
Orders are shipped within 1 – 3 business days from the time your order is processed, and delivery is made according to the times given below. No shipments/processing or deliveries are made on Saturdays, Sundays, or public holidays.
For shipping within Greece: The courier company we work with for shipping within Greece is Speedex Courier, while there is also the option of picking up your order from a BOX NOW locker. After your order has been delivered to one of the above courier companies that you will select when completing your order, we will either notify you by email of the tracking number assigned to your order (tracking number) assigned to your order by the courier company so that you can track its location at any time, or you will receive a message (SMS or Viber) from BOX NOW with a 6-digit PIN code so that you can collect your order from the automatic collection machine (locker).
For international shipping (outside Greece): The courier company we work with for shipments outside Greece is DHL. After your order has been delivered to the courier company, the latter will inform you of the tracking number assigned to your order so that you can track its location at any time.
Please note that because orders are linked to the online system of the courier companies we work with and are mentioned herein, it is not possible to ship your products with another courier company of your choice. International tax and customs charges
Customers are responsible for accepting their products based on the delivery options they choose.
International customers may be required to pay sales tax, customs duties, and/or customs fees. All taxes and customs duties are the responsibility of the Customer and are not included in the cost of the order or shipping charges. Taxes and customs duties vary depending on the country and state of the shipping address. We recommend that you contact your local customs office if you are unsure of the applicable taxes and customs duties that apply to you. Our company is not responsible for any additional taxes and customs duties required during the shipment of your order. Shipping costs for orders are non-refundable.
Please note that the international shipping costs provided by the Company do not reflect the cost of return shipping from countries outside Greece. It is the responsibility of Customers to inform themselves about the cost of returning shipments from their country to Greece, as this fee is not covered in any way by the Company. The above deadlines do not apply during periods of extreme weather conditions or strikes, pandemics, cases where courier companies have a particularly high workload due to the season, and in any case of force majeure that may affect transport and delivery times.
Delivery Delay
Our Company makes every effort to deliver your Products in a timely and proper manner; however, we reserve the right to delay the delivery of your Product(s) in cases such as, but not limited to, the following (a) the Product has been delayed in being shipped by our supplier, due to, for example, a transport hold-up, force majeure, etc., with the result that we do not have it in our warehouses when we calculate, (b) there is a force majeure event, such as extreme weather conditions, strikes, or any other event beyond our sphere of influence and control, which may affect the transport and delivery of your order, (c) there is a shortage of sufficient stock.
In the above cases, we will contact you to ask if you would like us to deliver your order without the delayed or unavailable Product, or to suggest an alternative, or inform you of the delivery time of the Product that is not immediately available. If you are not satisfied with our proposal, you have the right to cancel the order in part or in full, and we will refund any money you have paid. In case of delay, you can contact our Company at info@magdaviore.com, where you can cancel your order, in whole or in part.
Responsibility upon delivery
Please note that our Company remains solely responsible for any damage or loss of your Products until you (or third parties authorized by you) take physical possession of the Products.
If you are not at the address provided to receive the Products on the specified delivery date, the courier company will make two (2) further attempts on the following working days to deliver your order. If the shipment is ultimately unsuccessful, your order will be automatically returned to us and recorded as a Refusal. It is expressly agreed and by way of exception to the general rule of liability that applies to us, that you are responsible for the loss or damage of the Products, and the Products are stored in accordance with the terms of the carrier and at your expense.
Please note that our Company maintains a special list of customers who have placed orders and have not received their Products, (have refused or are not at the delivery address at the agreed time) or who have made large purchases (over 50 euros) and have refused delivery even once. Orders placed by customers registered on this list, for which cash on delivery has been selected as the payment method, will be canceled even if they have been successfully completed. If these customers choose one of the other payment methods, their order will be shipped as normal.

PAYMENT METHODS
Our Company, with a view to facilitating transactions and providing you with immediate service, offers all of the following payment options:
Payment by credit/debit card: You can use Visa, MasterCard and Klarna credit cards for your transactions. Your transactions in the Online Store are protected by the highest online security systems (RSA Encryption). To make a payment, fill in all the necessary fields (card number, expiry date, CCV) in the corresponding bank's environment. Our Company does not process your card details. Your card number is not stored unless you choose otherwise. Therefore, for each purchase in our Online Store that you wish to pay for by credit card, you must re-enter your card details.
Therefore, for every purchase in our Online Store that you wish to pay for by credit card, you will need to re-enter your card details.
Payment with PayPal: By selecting payment via PayPal, you will be redirected to the world-renowned website for secure transactions, where you can pay either without an account using your credit/debit card, or through your PayPal account. The process is completed in a very short time and during this time, no personal information (including your card details) is stored by our Company.

RETURN OF PRODUCTS/CANCELLATION
If for any reason you are not satisfied with your purchase, the Products may be returned within fifteen (15) calendar days from the date of delivery of your order and you may choose between: (i) a refund, (ii) a credit note, or (iii) a product exchange.

Refund
Refunds are made within ten (10) business days from the time the returned products are received by the Company and inspected. Your refund, if the purchase of the product from which you are withdrawing was made by cash on delivery, will be made by crediting your bank account (with the same name as the billing name on the order) which you will provide to us when exercising your right of withdrawal. If the payment was made by debit/credit card or PayPal, your money will be refunded to the account from which the charge was made. In the event of a return of products for a refund, which were purchased using a gift card, the refund amount will be credited back to the gift card until the original amount is covered.
The cooperating bank is EUROBANK ERGASIAS so in case of a refund to an account corresponding to the above, there is no additional charge. In case an account belonging to a non-partner bank is declared, the corresponding charges will be charged by your bank.

Issuing a credit code
A credit code can be issued, which can be used within one (1) year from the date of issue. The credit code takes the form of a discount code, is sent to you by email, and can be entered in the corresponding field when placing your order. Upon entry, the amount credited to the discount code is deducted from the total order amount.

Product Change
You must place a new order following the same procedure as for a normal cash on delivery order. However, in order for the amount/balance resulting from your returned items to be deducted, you must note the word "Change from X (order number)" in the "Comments" field. "Comments" field. Please note that the final amount with the credit will not be automatically displayed when you place your order, but will be deducted by us after your return has been processed. Please also note that you can place your new order even before your return has been shipped.
Conditions

The above deadline of fifteen (15) calendar days for exercising the right of withdrawal/return of the Products is defined from the day following the day on which you or a person you designate as responsible for receiving your Products (other than the carrier) acquires physical possession of the Products. If you have ordered more than one Product in a single order and they are delivered separately, the deadline for exercising the right of withdrawal, in accordance with the above, starts from the day after you or a person you designate as responsible for receiving your Products (other than the carrier) acquires physical possession of the last item. In any case, if the deadline falls on a weekend or public holiday, it is extended to the next working day.

A prerequisite is that the Product must be in its original packaging and in the same excellent condition, i.e. it must not have been damaged or impaired in any way since you received it. The acceptance or rejection of the return will be made after a quality check by our Company and an assessment of the condition of the returned Product. If a defect is found during the quality control of the returned Product, the Company must return the package to the consumer or contact the consumer to resolve the issue. Unwanted odors that the returned Product may have can also be considered a defect.

The return package must contain the retail receipt, the product's special markings (tags), and the return form, which accompanies every package that leaves our premises in printed form. If you lose the return form, you can find it available for printing right here.

Swimwear returns are made within 15 calendar days of receipt. It is essential that the protective hygiene sticker has not been removed and that the item is in the same excellent condition, i.e. it has not been damaged or worn, as when you received it. The acceptance or rejection of the return will be made after a quality check by our company and an assessment of the condition of the returned product.

For hygiene reasons, our company does not accept returns on hair accessories, earrings, and underwear.

Products sold as SETS must be returned as SETS. The return will not be accepted if all parts of the SET are not returned.

The initial choice of "CREDIT/EXCHANGE" cannot be changed to "REFUND".
Return costs
Returns for orders shipped within Greece are at your expense (€2.85 for returns with Speedex, €15 or €30 for returns with DHL and €2.50 for returns with BoxNow). This amount will be deducted from your exchange or refund and therefore does not need to be paid to the shipping company.
When delivering the package with the returned products to the above shipping company, you must select "Recipient charge". If you choose to make the return at your own expense or with any other courier company, the responsibility is yours and the shipping costs will be determined by the respective courier company.
In the event of a return due to receipt of an incorrect product due to an error on the part of the Company or a defective product, the costs of return and new shipment in the event of product replacement shall be borne by the Company.
Other Countries
If your order is returned from a country outside Greece, you will be charged for the return shipping costs, and the return will be made at the sender's expense. For returns from countries outside the European Union, customs duties, taxes, or other charges may be imposed when the products re-enter Greece. These charges are borne exclusively by the customer/shipper. Our Company is not responsible for covering these charges and reserves the right to withhold the corresponding amount from the final refund amount, if required. Upon completion of the purchase, the Customer is deemed to have read, understood, and unconditionally accepted this term.
Return Procedure
A) For orders delivered by Speedex:
1. Fill out the return form found in the original packaging and select the box marked "CREDIT/EXCHANGE" or the box marked "REFUND."
2. Place the return form in your package.
3. Return the product well packaged to avoid damage during transport.
4. Place the return voucher sticker on the outside of the package and give your package to the courier company.
B) For orders delivered with "Box Now":
1. Fill out the return form found in the original packaging and select the box marked "CREDIT/EXCHANGE" or the box marked "REFUND".
2. Place the return form in your package.
3. Your return will be processed using the original shipping voucher.
4. Enter the shipping number at the locker from which you received your package, place the package inside, and the Box Now driver will pick it up.
5. In order for the return to be completed successfully, you must place the original shipping voucher for your order in the package containing the returned items.

PLEASE NOTE: Until the product reaches us, it is your responsibility to ensure its safe transport in order to avoid any damage or loss and, consequently, the inability to return it. The acceptance or rejection of the return will be made after a quality check by our Company and an assessment of the condition of the returned product.

INCORRECT ORDER FULFILLMENT – DEFECTIVE PRODUCT
In case of an incorrect Product being shipped, you have the right, within 20 days of receiving the Product, contact us at our Company's email and inform us of our error in fulfilling your order and your desire to have the Product replaced with the correct product or to have your money refunded.
Our company undertakes to cover the total cost of returning and resending the correct product, provided that the return of the incorrect product and the shipment of the new one are carried out through Speedex, in case the return of the incorrect product is carried out from Greece. If, for any reason, you wish to use a different method of return/shipping, you will be responsible for the additional cost incurred by your own courier company in relation to the corresponding cost of Speedex.
You expressly acknowledge and accept that product replacement is subject to availability of the correct product in our stores at the time you notify us. If replacement is not possible, we will refund all money received from you, including any delivery costs (excluding additional costs incurred due to your choice to use other methods of return/delivery than the cheapest method of return/delivery we offer), subject to the provisions expressly set out below. The refund will be made immediately, without undue delay and in any case no later than ten days from the date on which the Company receives the products you have returned in accordance with the above provisions. You expressly agree that the replacement of products whose order was executed incorrectly will take place provided that the product to be replaced is returned to our Company in the same good condition in which you originally received it. Our Company does not replace products that are dirty, damaged, or do not come with all the documents (receipt, return form and/or proof of return, product tags) that you received from us.
The refund will be made by crediting your bank account, which you will provide us with when exercising your right of withdrawal. In any case, no fees will be charged for such refunds.
Claims for compensation or monetary satisfaction of any kind and legal basis are excluded, as are claims of any kind for damage to health, life, and physical integrity.
We make every effort to deliver the products you order without any actual defects and/or in accordance with what you see in the Online Store. The burden of proof that the above defects/shortcomings exist at the time of delivery of the product lies with you after one (1) year has elapsed, as required by law. In any case of our liability for non-compliance with the contract, you are entitled, at your discretion, to request replacement of the product, a reduction in price, or to withdraw from the contract, unless the defect is minor. Our Company does not undertake to repair products.
The terms and procedure mentioned above for the case of incorrect product shipment apply to the return of defective products.
